Gulf Pay Terms & Conditions
(Effective April 2023)

1. Introduction

1.1 These Gulf Pay Terms and Conditions, including the Gulf Pay Terms of Service, Gulf Pay Privacy Policy any other terms incorporated herein by reference (collectively, “Gulf Pay Terms”) constitute an agreement between you and Gulf Oil Limited Partnership (together with its affiliates and subsidiaries, collectively, “Gulf Oil”, “we”, “our” or “us”) relating to your participation in Gulf Pay.

1.2 Please read these Gulf Pay Terms carefully because they affect your legal rights.

1.3 Gulf Pay is a mobile application (referred to herein as “Gulf Pay” or the “App”) program owned by Gulf Oil which lets registered users pay for fuel through the app and earn rewards, including discounts on Gulf fuel, and receive other promotional offers by making qualifying purchases at participating Gulf Oil branded locations within the U.S. that participate in Gulf Pay. Gulf Oil branded locations are owned and operated by independent wholesalers or retailers and may opt not to participate in Gulf Pay.

1.4 By accessing or participating in Gulf Pay through using Gulf Pay on any mobile device, computer, mobile phone, tablet, console or other device, you confirm that you have read and agree to be bound by these Gulf Pay Terms.

1.5 For the purposes of these Terms and Conditions, any reference to “you” or “your” is a reference to the user of Gulf Pay.

2. Restriction and Access

2.1 To be eligible to enroll in Gulf Pay, you must be at least eighteen (18) years of age and have a residence in the United States. If you are under the age of majority in your home jurisdiction, you may only use Gulf Pay under the supervision of a parent or legal guardian who agrees to be bound by these Gulf Pay Terms. By using Gulf Pay, you are representing that you are at least 18 years old.

2.2 To fully register for Gulf Pay you must (i) first download Gulf Pay on a mobile device or visit on a web browser; and (ii) provide your first and last name, a valid email address, and a valid phone number; and (iii) agree to “opt-in” to receiving text messaging.

2.3When you register through Gulf Pay, you may also provide a valid credit card in the app, however, you are not required to do so to register and enroll in Gulf Pay.  

2.4 By enrolling and registering in Gulf Pay, you represent that all information you provide during registration and throughout your participation in Gulf Pay are true and accurate, and you agree to update such information, as necessary to maintain its truth and accuracy.

2.5 We reserve the right to approve, deny or revoke participation in Gulf Pay to any individual for any reason whatsoever on an immediate basis and without prior notice. If we determine that you have registered more than one (1) Gulf Pay account to your name/business, we reserve the right to terminate these accounts without notice.

2.6 Accessing Gulf Pay may require internet access. Your carrier’s mobile rates apply. 

2.7 Users may not: (a) remove any copyright, trade mark or other intellectual property notices contained in the material on the Gulf Pay App; (b) use the Gulf Pay App (or any part of it) in any unlawful manner, for any unlawful propose or in any manner inconsistent with the Gulf Pay Terms; (c) use the app in a way that could damage, disable, overburden, impair or compromise Gulf Oil’s systems or security, or interfere with other users; (d) collect or harvest any information or data from the Gulf Pay App; (e) circumvent or modify any security technology or software, without the express written consent from Gulf Oil. 

2.8 Gulf Oil may change these eligibility requirements at any time, with or without notice, and reserves the right to refuse enrollment to any user for any reason, in its sole discretion.

3. Gulf Pay for Purchases

3.1 Users of the Gulf Pay App can use its functionality to make payments for fuel and other goods from their mobile device at participating Gulf Oil service stations.

3.2 Within Gulf Pay, you may input information for one or more of your credit cards or other third-party payment method into the Gulf Pay Mobile Wallet (referred to herein as “Mobile Wallet”).  A single valid payment card can be added to multiple Gulf Pay Mobile Wallets. Upon linking cards in your Mobile Wallet for payment, you authorize that all transactions made using the Gulf Pay App at participating Gulf Oil branded locations will be charged to your designated credit card or method of payment, as applicable.

3.3 Gulf Pay may not accept all credit cards. In addition, Gulf Oil reserves the right to change, from time to time, the credit cards which may be linked to your account through the Gulf Pay Mobile Wallet.  Gulf Oil further reserves the right to disable any credit cards already linked to your account at any time and for any reason.

3.4 Any use of credit cards through Gulf Pay in your Mobile Wallet may be subject to the terms and conditions and/or the privacy policy of Gulf’s third-party designated mobile payment processor. When you provide a payment credential through Gulf Pay, you authorize the collection and storage of that payment credential, along with other related transaction information. When you fund a transaction, you authorize us (and our designated payment processor) to charge the full amount to the payment credential you designate for the transaction.  


4. Gulf Pay Discounts and Current Offers

4.1 All discounts will be automatically applied to the entirety of the eligible fuel purchase at participating Gulf Oil branded locations, provided the user makes such eligible fuel purchase through a valid credit card provided and stored in the Gulf Pay Mobile Wallet.

4.2 Gulf Pay Introductory Offer: Upon registration in Gulf Pay, users will receive $0.15 off per gallon of fuel purchased in their first transaction using Gulf Pay of up to 25 gallons through Gulf Pay at participating Gulf Oil locations. Participating locations are identified through the station locator in Gulf Pay. 

4.3 Gulf Oil and other third parties may provide you with additional ways to receive additional discounts through offers, promotions, and other programs. Such offers, promotions and programs may be subject to additional terms and conditions which shall be included in messaging to you regarding such offers, promotions and/or programs.

4.4 You will not receive discounts for: any purchases excluded by law; the value of any discounts or coupons outside of Gulf Pay; purchases that a particular Gulf Oil branded location rule ineligible for Gulf Pay; or taxes on purchases.

If you have a dispute regarding any eligible fuel purchase or discounts, you must notify the Gulf Pay Customer Service team at @gulfoil.comwithin thirty (30) days of the date the eligible fuel purchase was made or it will be deemed correct. You may be required to submit documentation to support your claim.

5. Additional Obligations

Gulf Oil is not responsible for any tax liability related to Gulf Pay. Any disputes concerning Gulf Pay will not affect your payment obligations for your fuel purchases. We are not responsible for any disputes among you or any authorized users relating to Gulf Pay.

6. Right to Change/Modify/Cancel Gulf Pay Terms

6.1 Gulf Oil may cancel, modify, restrict, waive or terminate any Gulf Pay Terms, including but not limited to the rules for earning and redeeming discounts and the expiration policy for discounts, at any time, with or without prior notice, even though these changes may affect your ability to use any discounts you have already earned.

6.2 Your continued participation in Gulf Pay constitutes your acceptance of any changes to the terms and conditions of Gulf Pay. You are responsible for remaining knowledgeable of any changes that Gulf Oil makes to Gulf Pay and the Gulf Pay Terms.

6.3 The most current version of these Gulf Pay Terms will be available on the website and will supersede all previous versions of these Gulf Pay Terms.

7. Changes to Gulf Pay or Termination

7.1 Gulf Oil may change the format, functionality or content of Gulf Pay at any time, for any reason and without providing advance notice to user. 

7.2 Users of the Gulf Pay App may be required to update the application on their device from time to time in order to use the most updated version. 

7.3 Your access to Gulf Pay will continue until such time as Gulf Oil decides to terminate Gulf Pay.  Gulf Oil may terminate Gulf Pay at any time in its sole discretion.  

7.4 Gulf Oil will provide notice of termination via the email address you supplied at the time of registration. Upon termination, your ability to earn additional discounts terminates immediately, and you will have to use any available discounts prior to the date of termination. After that date, any remaining discounts will be forfeited without compensation to you and without liability to Gulf Oil.

8. Disclaimer and Liability

8.1 To the fullest extent permitted by law, the functionality provided by Gulf Pay is on an “As Is” basis and Gulf Oil disclaims all guarantees, representations and warranties, express or implied regarding the operation or use of Gulf Pay, including but not limited to implied warranties of merchantability, satisfactory quality and fitness for a particular purpose. 

8.2 You understand and agree that use of Gulf Pay is at your own risk and that you are solely responsible for your use and any damage related to or caused by accessing, downloading or using Gulf Pay. You also expressly acknowledge and agree that you are not entitled to rely upon, and have not relied upon, any representation or warranty by Gulf Oil that is not expressly stated in these Gulf Pay Terms.

9. Program Void

Gulf Pay and discounts are void where prohibited by federal, state or local law or regulations. These Gulf Pay Terms set forth all the terms of Gulf Pay. Gulf Oil has no other obligation with respect to Gulf Pay beyond those described in these Gulf Pay Terms.

10. Account Information

To review available discounts and expiration status, please log in to your account on Gulf Pay or at to view your personal account information.

11. Indemnification

You agree to indemnity, defend, and hold harmless Gulf, its affiliates, officers, directors, employees, agents, licensors and suppliers from and against all claims, losses, liability, expenses, damages and costs, including without limitation, legal costs arising from or relating to your use of the App on any Device or any violation of these Terms and Conditions, any law or the rights of any third party.

12. Disputes and Jurisdiction

These Terms and Conditions are governed by the laws of the Commonwealth of Massachusetts and in the event of any dispute arising in relation to these Terms and Conditions or any dispute arising in relation to the Gulf Pay App, the state and federal courts in Massachusetts will have jurisdiction. BY YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS, THE USER AGREES THAT ANY CLAIMS OR DISPUTES SHALL BE BROUGHT ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS.

13. Data Collection and Privacy Policy

The Gulf Pay App is operated by Stuzo, LLC. Personal data collected enables us to provide you with additional features/functionality. In addition, we use anonymized and aggregated information for purposes that include testing our IT systems, research, data analysis, creating marketing and promotion models, improving Gulf Pay, and developing new features and functionality within Gulf Pay. We collect your personal data in the following ways:

A. Account Registration Data. When you sign up Gulf Pay you provide and we collect certain personal data such as your name, email address, birth date, and postal code so you can use Gulf Pay.

B. Gulf Pay Usage Data. When you use Gulf Pay you provide and we collect personal data about your use of Gulf Pay. Personal data about you when you are using Gulf Pay may include (i) information about your interactions with Gulf Pay such as the date and time of any purchases you make, advertisements you have listened to or watched, and (ii) technical data such as URL information, cookie data, your IP address, the types of devices you are using to access or connect to Gulf Pay, device attributes, network connection type (e.g. WiFi, 3G, LTE, Bluetooth) and provider, network and device performance, browser type, language, information enabling digital rights management, operating system, and Gulf Pay application version.

C. Voluntary Mobile Data. With your consent, we may collect additional personal data from your mobile device (e.g., your precise mobile device location or your voice data to enable you to interact with Gulf Pay with your voice) to provide you with features/functionality that will enhance your Gulf Pay experience.

D. From third parties. We may receive personal data about you and your activity from third parties, including advertisers and partners we work with to provide you with Gulf Pay. We will use this personal data either where you have provided your consent to the third party or to Gulf Oil. We may also receive information from other sources and combine that with information we collect through Gulf Pay such as for example (i) if you choose to link, create, or log in to your Gulf Pay account with a payment provider (e.g., Apple Pay) or social media service (e.g., Facebook), or if you engage with a separate app or website that uses our API (or whose API we use), we may receive information about you or your connections from that site or app, or (ii) if you also interact with Stuzo, LLC in another capacity, for instance as a Store Owner or user of other apps we provide, we may combine or associate that information with information we have collected from you in your capacity as a User.

14. Severability

If any provision in these Gulf Pay Terms is considered invalid under the rule of law, it shall be regarded as stricken while the remainder these Terms shall continue to be in full force and effect.

Gulf Pay Terms of Service

  1. When you opt-in to the service, we will send you an SMS message to confirm your signup.
  2. You can cancel the SMS service at any time. Just text "STOP" to 1-855-950-4853. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.

    If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

  3. If at any time you forget what keywords are supported, just text "HELP" to 1-855-950-4853. After you send the SMS message "HELP" to us, we will respond with instructions on how to use our service as well as how to unsubscribe.
  4. We are able to deliver messages to the following mobile phone carriers:

    Major carriers: AT&T, Verizon Wireless, Sprint, T-Mobile, MetroPCS, U.S. Cellular, Alltel, Boost Mobile, Nextel, and Virgin Mobile.

    Minor carriers: Alaska Communications Systems (ACS), Appalachian Wireless (EKN), Bluegrass Cellular, Cellular One of East Central IL (ECIT), Cellular One of Northeast Pennsylvania, Cincinnati Bell Wireless, Cricket, Coral Wireless (Mobi PCS), COX, Cross, Element Mobile (Flat Wireless), Epic Touch (Elkhart Telephone), GCI, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri), Illinois Valley Cellular, Inland Cellular, iWireless (Iowa Wireless), Keystone Wireless (Immix Wireless/PC Man), Mosaic (Consolidated or CTC Telecom), Nex-Tech Wireless, NTelos, Panhandle Communications, Pioneer, Plateau (Texas RSA 3 Ltd), Revol, RINA, Simmetry (TMP Corporation), Thumb Cellular, Union Wireless, United Wireless, Viaero Wireless, and West Central (WCC or 5 Star Wireless).

  5. As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages weekly unless communication needs require more frequent messages in which case you may receive messages every other day (maximum). Gulf Pay Privacy Policy

The Gulf Oil Limited Partnership Gulf Pay text messaging application and the associated Gulf website available at (“Gulf Pay text messaging”) are owned and operated by Gulf Oil Limited Partnership, who, together with all entities that control, are controlled by, or are affiliated or under common control with Gulf Oil Limited Partnership are collectively referred to herein as ("us" "we" or "our"). This Gulf Pay privacy policy (the "Gulf Pay Privacy Policy") is intended to inform you of our policies and practices regarding the collection, use and disclosure of any information you submit to us through Gulf Pay text messaging. This includes "Personal Information," which is information about you that is personally identifiable such as your name, e-mail address, user ID number, and other non- public information that is associated with the foregoing, as well as "Anonymous Information," which is information that is not associated with or linked to your Personal Information and does not permit the identification of individual persons.

User Consent

By accessing or otherwise using Gulf Pay text messaging you agree to the terms and conditions of this Gulf Pay Privacy Policy and the associated Terms of Service (set forth on you expressly consent to the processing of your Personal Information and Anonymous Information according to this Gulf Pay Privacy Policy.

Your Personal Information may be processed by us in the country where it was collected as well as other countries (including the United States) where laws regarding processing of Personal Information may be less stringent than the laws in your country.

Regarding Children

Children under the age of 13 are not permitted to use Gulf Pay text messaging and we do not intentionally collect or maintain Personal Information from those who are under 13 years old. Protecting the privacy of children is very important to us. Thus, if we obtain actual knowledge that a user is under 13, we will take steps to remove that user's Personal Information from our databases. We recommend that children between the ages of 13 and 18 obtain their parent's permission before submitting information over the internet. By using Gulf Pay text messaging, you are representing that you are at least 18 years old, or that you are at least 13 years old and have your parents' permission to use Gulf Pay text messaging.


Collection and Use of Information

Personal Information

In general, we collect Personal Information that you submit to us voluntarily through Gulf text messaging. We also collect information that you submit in the process of creating or editing your account and user profile on Gulf Pay text messaging. For example, our registration and login process requires you to provide us with your name, valid email address and password of your choice. When you personalize your profile and use the features of Gulf Pay text messaging, we will collect any information you voluntarily provide, and we may also request optional information to support your use of Gulf Pay text messaging, such as your year of birth, gender and other demographic information. We collect information in the form of the content that you submit during your use of Gulf Pay text messaging, such as photos, comments, ratings and other information you choose to submit. We may also collect information about you and your friends, from any social network you may have connected from, in order to provide you with a more personalized experience. For instance, we may collect your user ID or profile information that you have permitted to be displayed through Gulf Pay text messaging in order to display you as a friend or in association with your profile and collections. When you order our products or services, you will need to submit your credit card or other payment information so that our service providers can process your payment for those products and services. If you choose to sign up to receive information about products or services that may be of interest to you, we will collect your email address and all related information. Additionally, we collect any information that you voluntarily enter, including Personal Information, into any postings, comments, or forums within the Gulf Pay text messaging community.

Personal Information from Other Sources

We may receive Personal Information about you from other sources with which you have registered, companies who we have partnered with (collectively, "Partners") or other third parties. We may associate this information with the other Personal Information we have collected about you.

E-mail and E-mail Addresses

If you send an e-mail to us or fill out our "Feedback" form through Gulf Pay text messaging, we will collect your e-mail address and the full content of your e-mail, including attached files, and other information you provide. We may use and display your full name and email address when you send an email notification to a friend through Gulf Pay text messaging or the social network from which you have connected to Gulf Pay text messaging (such as in an invitation, or when sharing your content). Additionally, we use your email address to contact you on behalf of your friends (such as when someone sends you a personal message) or notifications from a social network or other website with whom you have registered to receive such notifications.

We may use this e-mail address to contact you, for things such as notifications of limited-edition shop sales and other related information. You may indicate your preference to stop receiving further promotional communications as further detailed below.

Information Collected Via Technology

As you use Gulf Pay text messaging, certain information may also be passively collected and stored on our or our service providers' server logs, including your Internet protocol address, browser type, and operating system. We also use Cookies and navigational data like Uniform Resource Locators (URL) to gather information regarding the date and time of your visit and the solutions and information for which you searched and viewed, or on which of the advertisements displayed on Gulf Pay text messaging you clicked. This type of information is collected to make Gulf Pay text messaging and solutions more useful to you and to tailor the experience with Gulf Pay text messaging to meet your special interests and needs.

An "Internet protocol address" or "IP Address" is a number that is automatically assigned to your computer when you use the Internet. In some cases, your IP Address stays the same from browser session to browser session; but if you use a consumer internet access provider, your IP Address probably varies from session to session. For example, we, or our service providers, may track your IP Address when you access Gulf Pay text messaging to assist with ad targeting.

"Cookies" are small pieces of information that a website sends to your computer's hard drive while you are viewing a website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience with Gulf Pay text messaging. Persistent Cookies can be removed by following your Internet browser help file directions. In order to use our services offered through Gulf Pay text messaging, your web browser must accept Cookies. If you choose to disable Cookies, some aspects of Gulf Pay text messaging may not work properly, and you will not be able to receive our services.

We may also enable advertisers and ad servers to promote third-party products and/or services by placing advertisements on Gulf Pay text messaging. These advertisers and ad servers may use Cookies and/or "Web Beacons" (which are usually small, transparent graphic images) in order to monitor information related to served advertisements. Clicking on such advertisements will direct you to the website of a third-party and the advertiser. This Gulf Pay Privacy Policy does not cover the privacy practices of any advertisers or ad servers.

Use and Disclosure of Information
Except as otherwise stated in this Gulf Pay Privacy Policy, we do not generally sell, trade, rent, or share the Personal Information that we collect with third parties, unless you ask or authorize us to do so.

In general, Personal Information you submit to us is used by us to provide you access to Gulf Pay text messaging, to improve Gulf Pay text messaging, to better tailor the features, performance, and support of Gulf Pay text messaging and to offer you additional information, opportunities, promotions and functionality from us, our partners or our advertisers at your request. Additionally, we do share your content preferences and other information with the social network from which you have connected to Gulf Pay text messaging, along with those companies and persons you have asked us to share your information with.

We may provide your Personal Information to third-party service providers who work on behalf of or with us to provide some of the services and features of Gulf Pay text messaging and to help us communicate with you. Examples of such services include sending email, analyzing data, providing marketing assistance, processing payments (including credit card payments), and providing customer service. We require our third-party service providers to promise not to use such information except as necessary to provide the relevant services to us. This Gulf Pay Privacy Policy does not cover the use of your personally identifiable information by such third parties. We do not maintain responsibility for the manner in which third parties, including, without limitation, social networks, other partners and advertisers, use or further disclose Personal Information collected from you in accordance with this Gulf Pay Privacy Policy, after we have disclosed such information to those third parties. If you do not want us to use or disclose Personal Information collected about you in the manners identified in this Gulf Pay Privacy Policy, you may not use Gulf Pay text messaging.

In the event we go through a business transition such as a merger, acquisition by another company, or sale of all or a portion of its assets, your Personal Information may be among the assets transferred. You acknowledge that such transfers may occur and are permitted by this Gulf Pay Privacy Policy, and that any acquirer of ours or that acquirer’s assets may continue to process your Personal Information as set forth in this Gulf Pay Privacy Policy.

We may disclose your Personal Information if we believe in good faith that such disclosure is necessary to (a) comply with relevant laws or to respond to subpoenas or warrants served on us; or (b) to protect and defend our rights or property, you, or third parties. You hereby consent to us sharing your Personal Information under the circumstances described herein.

The Ability of others to View your Information

Helping you to protect your information is a vital part of our mission. It is up to you to make sure you are comfortable with the information you choose to provide us and the information you choose to publish. You understand that when you use Gulf Pay text messaging, certain information you post or provide through Gulf Pay text messaging, such as your name, profile, comments, posts and ratings, may be shared with other users and posted on publicly available portions of Gulf Pay text messaging, including without limitation, chatrooms, bulletin and message boards, along with other public forums. Please keep in mind that if you choose to disclose Personal Information when posting comments or other information or content through Gulf Pay text messaging, this information may become publicly available and may be collected and used by others, including people outside the Gulf Pay text messaging community. We will not have any obligations with respect to any information that you post to parts of Gulf Pay text messaging available to others and recommend that you use caution when giving out personal information to others in public forums online or otherwise. We also share the information you publish with other third parties.

Third Party Sites and Advertising

Gulf Pay text messaging may contain links to other websites. Please be aware that we are not responsible for the privacy practices or the content of such other websites. We encourage our users to read the privacy statements of each and every website they visit. This Gulf Pay text messaging applies solely to information collected by us through Gulf Pay text messaging and does not apply to these third-party websites. The ability to access information of third- parties from Gulf Pay text messaging, or links to other websites or locations, is for your convenience and does not signify our endorsement of such third parties, their products, their services, other websites, locations or their content.

Your Choices Regarding Your Personal Information

We offer you choices regarding the collection, use, and sharing of your Personal Information. When you receive promotional communications from us, you may indicate a preference to stop receiving further promotional communications from us and you will have the opportunity to "opt-out" by following the unsubscribe instructions provided in the promotional e-mail you receive or by contacting us directly (please see contact information below).

Despite your indicated email preferences, we may send you administrative emails regarding Gulf Pay text messaging, including, for example, administrative confirmations, and notices of updates to our Gulf Pay Privacy Policy if we choose to provide such notices to you in this manner.

You may change any of your profile information by editing it in the profile settings page. You may request deletion of your Personal Information by contacting us at but please note that we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request, only after we have fulfilled such requirements). When we delete Personal Information, it will be deleted from the active database, but may remain in our archives.


If you provide feedback to us, we may use and disclose such feedback for any purpose, provided we do not associate such feedback with your Personal Information. We will collect any information contained in such feedback and will treat the Personal Information in it in accordance with this Gulf Pay Privacy Policy. You agree that any such comments and any email we receive becomes our property. We may use feedback for marketing purposes or to add to or modify our services without paying any royalties or other compensation to you.


We are committed to protecting the security of your Personal Information. We use a variety of industry-standard security technologies and procedures to help protect your Personal Information from unauthorized access, use, or disclosure. Even though we have taken significant steps to protect your Personal Information, no company, including us, can fully eliminate security risks associated with Personal Information.

Contact and Revisions

If you have questions or concerns about our Gulf Pay Privacy Policy, please contact us at This Gulf Pay Privacy Policy is subject to occasional revision at our discretion, and if we make any substantial changes in the way we use your Personal Information, we will post an alert on this page. If you object to any such changes, you must cease using Gulf Pay text messaging. Continued use of Gulf Pay text messaging following notice of any such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
